PURCHASE AGREEMENT AND SITE REQUIREMENTS FOR DELIVERY AND INSTALLATION


PURCHASE AGREEMENT 
This Purchase Agreement ("Agreement") sets forth the terms and conditions governing the purchase, delivery, and installation of equipment from Better Brands Co ("Seller") to the customer ("Buyer"). By placing an order, Buyer agrees to comply with the terms outlined herein. 


ORDER CONFIRMATION AND PAYMENT 

  • All orders must be confirmed in writing, including equipment specifications, pricing, and delivery details.
  • Full payment is required before order processing begins.
  • Payments are accepted via ACH, Wire, and Credit Card (merchant fee will apply) all transactions are subject to verification.

DELIVERY TERMS

  • Delivery dates are estimated and subject to availability.
  • Buyer must provide accurate delivery details; Seller is not responsible for delays due to incorrect information.
  • Delivery will be made to the designated site per the agreed schedule. 

SITE REQUIREMENTS FOR DELIVERY AND INSTALLATION
To ensure a smooth installation process, Buyer must meet the following site requirements: 

  • Accessibility: The site must be accessible to delivery vehicles, including adequate space for unloading.
  • Power and Utilities: Required electrical and plumbing connections must be in place before installation.
  • Flooring and Structural Integrity: The installation area must be level and capable of supporting the weight of the equipment.
  • Permits and Compliance: Buyer is responsible for obtaining any required permits and ensuring compliance with local regulations.

INSTALLATION AND SETUP 

  • Seller will provide professional installation services if included in the purchase agreement.
  • Any additional work required due to non-compliance with site requirements may incur additional charges.
  • Buyer must ensure personnel are available for any necessary coordination during installation. 

RISK OF LOSS AND DAMAGE

  • Risk of loss transfers to Buyer upon delivery unless otherwise agreed.
  • Buyer must inspect equipment upon delivery and report any damages immediately.

WARRANTY AND SUPPORT

  • The warranty period and terms are specified in the product documentation.
  • Seller will provide troubleshooting and support within the warranty terms.

CANCELLATION AND RETURNS

  • Orders may be canceled before shipment, subject to a cancellation fee.
  • Returns are subject to Seller's return policy and may require a restocking fee. 

LIMITATION OF LIABILITY

  • Seller is not liable for delays, damages, or losses caused by factors beyond reasonable control.
  • Liability is limited to the repair or replacement of defective equipment as per the warranty terms. 

GOVERNING LAW
This Agreement shall be governed by the laws of [Jurisdiction]. Any disputes shall be resolved in accordance with the applicable legal procedures.
